Terms of Service

These Terms of Service govern your use of the Mailsflux email infrastructure platform, operated by BLOOMBERG INTELLIGENT TECHNOLOGY. By using Mailsflux, you agree to these Terms. Please read them carefully — particularly the sections on permitted use and prohibited use.

1. Acceptance of Terms

By accessing or using Mailsflux ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These Terms apply to all users, including free plan users and paid subscribers.

2. Description of Service

Mailsflux provides a unified email infrastructure platform including transactional email delivery via API, physical mail delivery via API, marketing email tools, audience management, delivery analytics, and related developer SDKs. Mailsflux acts as a technology service provider — you are responsible for the content of the messages you send and the recipients you contact.

3. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms and all applicable anti-spam laws (including CAN-SPAM, CASL, and GDPR). Permitted uses include sending transactional emails triggered by user actions, marketing emails to opted-in recipients, physical mail to consenting recipients, and automated notifications. You must maintain valid opt-in records for all marketing communications and honor unsubscribe requests within 10 business days.

4. Prohibited Use

You must not use the Service to: • Send unsolicited commercial email (spam) or bulk email to purchased or harvested lists • Send email containing malware, phishing content, or deceptive material • Send physical mail containing illegal content or violating postal regulations • Impersonate another person, company, or domain you do not own or have authorization to use • Attempt to circumvent sending limits, rate limits, or account restrictions • Resell or white-label Service access without a written reseller agreement • Violate any applicable anti-spam, data protection, or communications law

5. Sending Domain & Identity

You must verify ownership of any sending domain before using it to send email through Mailsflux. By adding a domain, you represent that you are authorized to send email on behalf of that domain. Mailsflux reserves the right to suspend sending from domains that generate excessive bounces, spam complaints, or show evidence of abuse.

6. Deliverability & Compliance

Mailsflux provides tools to help maintain high deliverability (SPF/DKIM/DMARC setup, IP warm-up, blacklist monitoring). However, deliverability is also dependent on the quality of your email lists and content. Mailsflux does not guarantee inbox placement. You are responsible for maintaining list hygiene and a complaint rate below 0.1%.

7. Data Ownership

You retain ownership of all data you import, create, or generate through the Service, including email templates, recipient lists, and analytics. Mailsflux does not claim ownership rights over your content. Mailsflux may retain anonymized, aggregated usage statistics for service improvement.

8. Service Availability & SLA

Mailsflux targets 99.9% API uptime for Enterprise plans as described in the applicable Service Level Agreement. Free and Growth plans do not include an SLA guarantee. Planned maintenance windows will be announced with at least 24 hours' notice via our status page at status.mailsflux.net.

9. Billing & Cancellation

Subscription fees are billed monthly or annually in advance. Overage charges are billed in arrears at the end of each billing period. All fees are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and your quota remains available until then.

10. Account Suspension

Mailsflux reserves the right to suspend or terminate accounts that: exceed a spam complaint rate of 0.1%, send to invalid or unverified lists causing bounce rates above 5%, are used for phishing or malware distribution, or otherwise violate these Terms. We will provide notice prior to suspension where reasonably possible, except in cases of severe abuse.

11. Limitation of Liability

To the maximum extent permitted by law, Mailsflux shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of revenue, business, or data. Our total liability for any claim arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Mailsflux and its affiliates from any claims, damages, or expenses (including legal fees) arising from: your use of the Service, the content of messages you send, your violation of these Terms, or your violation of any applicable anti-spam or data protection law.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
